Proposed Encroachment Eligibility Questionnaire*

*This stage of the process is only to determine your eligibility to apply for an encroachment. This is not an encroachment application.

 


 

 

Question 1

Is the proposed encroachment extending onto a City-owned park or greenspace? (City-owned parks and greenspaces include both non-reserve park land including Public Utility Lots (PULs) AND park land designated as Municipal Reserve (MR), School Reserve (SR), Municipal & School Reserve (MSR), Environmental Reserve (ER), Community Reserve (R) etc.)

You are not eligible to apply for an encroachment agreement.

City-owned parks and greenspaces are for ALL Calgarians to enjoy and are not intended for the exclusive or private use of individuals over extended periods of time. In addition, encroachments extending onto land designated as reserve land are not permitted pursuant to Encroachment Bylaw 9M2020 and the Municipal Government Act (Alberta).

Question 2

Is the proposed encroachment a permanent structure? (Permanent structures are structures that are not easily removable and include but are not limited to: residential dwellings, foundations, garages, accessory buildings such as a shed greater than 10 sq. m., in-ground swimming pools, decks, patios with a foundation or piles, etc.)

You are not eligible to apply for an encroachment agreement.

 

Please revise your plan or drawing to ensure that any proposed permanent structures are not encroaching onto a City of Calgary property or interest (i.e. a City utility right of way, overland drainage right of way, road right of way/boulevard, City parcel etc.)

Question 3

Is the proposed encroachment creating a private enclosure of road right of way/boulevard with a fence, wall or similar structure? (A private enclosure is when you are enclosing a public road right-of-way/boulevard using a fence, wall or similar structure. The boulevard could be a portion of the grass between the curb and the sidewalk or between the sidewalk and your property line; or where no sidewalk exists, a portion of the grass between the curb and your property line.)

It does not appear that you are eligible to apply for an encroachment agreement.

 

Private enclosures of road right of way (i.e., boulevard) are not supported as this land is required to provide free and clear access to The City and utility providers for maintenance of public infrastructure, utilities, public trees, and for public access.

Question 4

Are you proposing to plant trees or similar landscaping into a utility right-of-way (URW) on your property?

Not eligible.



You are not eligible to apply for an encroachment agreement.

 

Trees or similar landscaping are not permitted within the URW. Most URWs contain shallow, and sometimes deep, utility infrastructure which could be impacted by tree roots or other similar landscaping.
